Backflow and TMV Testing for Moreton Bay Businesses: What’s Required

If you run a business in the Moreton Bay region and you’ve got plumbing connected to the public water supply, you have legal obligations around backflow prevention and thermostatic mixing valve (TMV) testing. These aren’t optional extras. They’re regulatory requirements under Queensland’s Plumbing and Drainage Act 2018 and the associated regulations.

The consequences of non-compliance range from council notices to fines to insurance problems. And if a backflow event actually contaminates the water supply, the liability exposure is significant. Here’s what you need to know.

Backflow prevention: what and why

Backflow happens when water flows backwards through the plumbing system, from your property back into the public water supply. This is a serious contamination risk, because the water flowing backwards may carry chemicals, bacteria or other contaminants. Common backflow risks in commercial properties:

  • Chemical storage and mixing areas: cleaning or industrial chemicals connected to hoses that also connect to the water supply
  • Irrigation systems: garden and lawn irrigation connected to the mains can suck contaminated water back if pressure drops
  • Fire services: fire hydrant and sprinkler systems connected to the mains supply
  • Commercial kitchens: dishwashers, pre-rinse sprays and food prep equipment connected to the water supply
  • Medical and dental practices: equipment that uses water for cooling or flushing
  • Hairdressers and beauty salons: basins and equipment with potential chemical backflow

What backflow devices do you need?

The type of backflow prevention device depends on the hazard level:

  • High hazard (RPZ valves): required where a backflow event could contaminate the supply with substances dangerous to health, such as chemical storage, medical facilities and commercial kitchens with chemical dispensing. RPZ (Reduced Pressure Zone) valves are the most complex devices but give the highest protection.
  • Medium hazard (double check valves): required where backflow could cause taste, odour or appearance issues but isn’t a direct health risk, such as irrigation, fire services and general commercial connections.
  • Low hazard (atmospheric gap or dual check): for connections with minimal contamination risk.

Annual testing is mandatory

Under Queensland regulations, backflow prevention devices must be tested annually by a licensed plumber with backflow testing qualifications. This isn’t a recommendation, it’s a legal requirement. The annual test verifies:

  • The device operates correctly: check valves seal, relief valves discharge at the right pressure, all components function as designed
  • No bypass exists: water can’t circumvent the device through plumbing modifications or valve positions
  • The device is accessible: if someone has built a wall or cupboard around it, that’s a compliance issue
  • Documentation: each test generates a Form 9 (Test Report for Backflow Prevention Device) that must be submitted to Moreton Bay Regional Council

TMV testing: temperature safety

Thermostatic mixing valves control the temperature of hot water delivered to taps and showers. They’re required by the Queensland Plumbing Code at any fixture where scalding is a risk. Temperature requirements:

  • Maximum 50°C at general outlets: basins, showers and baths in commercial settings must be tempered to no more than 50 degrees
  • Maximum 45°C for vulnerable users: facilities used by children, elderly or people with disabilities, including childcare centres, aged care, schools and disability accommodation
  • Hot water stored at 60°C minimum: the system stores water at 60 degrees or above to prevent legionella, and the TMV mixes it down to a safe delivery temperature

TMVs must be tested annually. Over time, scale buildup (especially in Caboolture’s hard water), component wear and seal degradation cause TMVs to drift out of specification. A TMV delivering water above the prescribed temperature creates a scalding risk. One delivering water below temperature from a system stored below 60 degrees is a legionella risk.

Moreton Bay Council registration requirements

Moreton Bay Regional Council maintains a register of backflow devices in its area. Property owners and managers are required to:

  • Register all backflow devices: when a device is installed, it must be registered with council
  • Submit annual test reports (Form 9): after each annual test, the completed Form 9 must be submitted. Council tracks compliance and follows up on overdue tests.
  • Notify council of changes: if a device is replaced, removed or modified, council must be notified

Failure to submit test reports results in follow-up notices from council, escalating to compliance action if ignored.

Consequences of non-compliance

  • Council notices and fines: overdue test reports trigger follow-up action that can include improvement notices and financial penalties
  • Insurance implications: if a backflow event occurs and your device wasn’t tested or maintained, your business insurance may not cover the resulting claims
  • Liability for contamination: a backflow event that introduces contaminants into the public supply can affect neighbouring properties and the wider community, and the responsible party can be held liable for remediation costs
  • Health and safety risk: a TMV out of specification creates a direct injury risk, either scalding burns or legionella exposure, both carrying significant liability

Frequently asked questions

How often do backflow devices need testing?

Annual testing is the legal requirement in Queensland. Some high-hazard installations may require more frequent testing depending on the conditions of the plumbing approval. We schedule your annual test and send reminders so you never miss a deadline.

What is a Form 9?

A Form 9 is the official test report for a backflow prevention device under the Queensland Plumbing and Drainage Regulation. It records the device details, test results and whether the device passed or failed. The completed form must be submitted to the local council after each annual test.

Can any plumber test backflow devices?

No. Backflow device testing must be done by a plumber who holds a current backflow prevention testing endorsement on their licence. This requires specific training beyond a standard plumbing licence. We hold the required endorsements for all types of backflow testing.

What happens if my backflow device fails the annual test?

If the device fails, it needs to be repaired or replaced and retested before the Form 9 can be submitted as a pass. Common failures include worn check valve seals, stuck relief valves and damaged diaphragms. We carry common repair parts and can usually fix and retest on the same visit.

Do residential properties need backflow testing too?

Most residential properties don’t require registered backflow devices unless they have specific installations like irrigation connected to mains supply, swimming pool auto-fill systems, or rainwater tank connections with mains backup. If your home has any of these, a testable backflow device may be required.
